The 3 member investigation panel on Saturday headed by Mr. Aftab Alam who is the Supreme Court Judge had adjourned the proceedings related to the removal of Chief Justice of the Sikkim High Court Mr. P.D. Dinakaran, who had resigned his job on the day before yesterday.When the panel assembled last morning, counsel for Justice Mr. P.D. Dinakaran wasn’t present and in the absence of an official communication on the resignation of Justice Mr. Dinakaran, it was decided to withdraw the proceedings.

The removal proceedings, started under the Judges Inquiry Act consistant to a movement included in the Rajya Sabha, will become infructuous once the President accepts the resignation of Justice Dinakaran. The investigation panel will formally write to Mr. Hamid Ansari the Rajya Sabha Chairman to end the proceedings.

It was the advice of the senior lawyers Mr. Ashok Bhan and Mr. Amarendra Saran, appearing for Justice Mr. P.D Dinakaran, that he should put in his papers. In Justice Dinakaran’s resignation letter he expressed his apprehension that he might not get the justice. The letter says that “…it is also obvious that hearing before the committee is just an empty formality. Hence, I have lost confidence of getting fair hearing and justice even before the reconstituted committee. In the above factual background I am unable to repose any faith and confidence in the committee and in the procedure being adopted by them. I am, therefore, of the firm view that there would not be any gainful purpose in appearing for the committee in spite of my innocence.”
